1. Program & Tuition
Student must meet Texas minimum age requirements for teen driver education enrollment.
Teen Driver Education Program with Driving — $475
- 24 hours classroom instruction
- 7 hours behind-the-wheel instruction
- 7 hours in-car observation
Total Instructional Hours: 38 hours
Teen Classroom-Only Program — $100
- 24 hours classroom instruction
- No driving instruction included
Total Instructional Hours: 24 hours
Road testing services are not included in tuition and must be purchased separately after course completion.
All instruction is provided in accordance with Texas Occupations Code Chapter 1001 and rules administered by the Texas Department of Licensing and Regulation (TDLR).
2. Definition of Instructional Hour
For attendance, completion, and refund calculation purposes:
- One (1) instructional hour equals fifty-five (55) minutes of verified instructional time as recorded by the School’s learning management system or instructor log.
- Online lessons labeled “Hour 1,” “Hour 2,” etc. constitute one completed instructional hour once the required timed instruction is satisfied.
- Behind-the-wheel and observation sessions scheduled for one hour constitute one instructional hour.
- Instructional hours are considered completed once the student satisfies the timed lesson requirement and completes the lesson module.
3. Course Start & Completion Timeframe
- Course Start means the date the Student begins the course or the date the School enrolls the Student, whichever occurs first.
- Students have three hundred sixty-five (365) days from the Course Start date to complete all required instructional hours unless otherwise required by Texas law.
- The School has no obligation to provide instruction beyond the 365-day completion period.
- If the Student fails to complete the course within 365 days, re-enrollment and additional tuition may be required.
4. Three-Day Right to Cancel
The Student (or Parent/Guardian if the Student is under 18 years of age) may cancel within three (3) business days after enrollment and receive a full refund of all tuition paid.
Cancellation must be submitted in writing to info@drivesmartdfw.com or delivered in writing to the School.
5. Refund Policy
Refunds will be calculated in accordance with Texas Occupations Code Chapter 1001 and applicable rules of the Texas Department of Licensing and Regulation.
After the three-day cancellation period, refunds will be calculated on a pro-rata basis based on the portion of instruction not yet provided.
Total Tuition for Teen Program with Driving: $475
Tuition Allocation
- Classroom Instruction (24 hours) — $375
- Behind-the-Wheel Instruction (7 lessons) — $100
- Observation Instruction (7 hours) — Provided at no additional charge
Refund Calculations
Classroom Refund Calculation
Refund = $375 − (Instructional Hours Completed ÷ 24 × $375)
Behind-the-Wheel Refund Calculation
Refund = $100 − (Driving Lessons Completed ÷ 7 × $100)
Observation instruction is provided at no additional charge and is not included in refund calculations.
Completion of Classroom Phase
Once the student has completed the required 24 hours of classroom instruction or a DE-964 certificate has been issued, the classroom portion is considered earned by the school.
No refund will be issued for the classroom portion once a DE-964 certificate has been issued.
Any refund due after issuance of a DE-964 will be calculated only on the unused behind-the-wheel portion of the program.
Course Completion
No refund will be issued once all required instructional hours for the program have been completed.
Expiration of Course
If the student fails to complete the program within the 365-day completion period, the student may be administratively withdrawn. Any refund due will be calculated based on instruction completed at the time of withdrawal.
Refund Processing
Refunds will be issued within thirty (30) days of written cancellation.
6. Driving Session Policy
Behind-the-wheel or observation sessions canceled with less than twenty-four (24) hours’ notice or missed without notice may be considered completed for refund calculation purposes.
7. Transfer Policy
- A student may transfer to another licensed driver education school.
- Upon written request, the School will provide documentation of instructional hours completed.
- Any refund due will be calculated according to this Agreement and applicable Texas law.
8. Interruption of Training
If training is interrupted for thirty (30) consecutive days or more, the School may require written confirmation of the Student’s intent to continue.
Failure to respond may result in administrative withdrawal consistent with the refund provisions.

10. Limitation of Liability
To the maximum extent permitted by law, the School’s total liability for any claim arising from this program shall not exceed the total tuition paid.
This limitation does not apply where prohibited by law.
11. Dispute Resolution & Arbitration
Any dispute arising out of or relating to this program shall be resolved through binding arbitration administered by the American Arbitration Association.
Arbitration shall occur in Denton County, Texas.
Nothing in this section limits the Student’s right to file a complaint with the Texas Department of Licensing and Regulation.
12. Payment Disputes / Chargebacks
The Student and Parent/Guardian agree that billing questions or refund requests will first be submitted to the School for resolution.
Filing a payment dispute or chargeback without first contacting the School may delay resolution of the matter.
Nothing in this section limits any rights provided under Texas law.
13. Identity Verification & Course Integrity
The student must personally complete all coursework, quizzes, examinations, and instructional activities associated with this program.
The School may utilize identity verification systems, including multi-factor authentication (MFA), login monitoring, and activity tracking to verify that the enrolled Student is the individual completing the course.
If the School determines, in its reasonable discretion, that the student has allowed another individual to access the course, complete coursework, bypass identity verification requirements, or otherwise misrepresent the identity of the person completing the instruction, the Student may be administratively removed from the program.
Administrative removal for identity misrepresentation or violation of course integrity requirements may result in termination of course access and denial of any certificate of completion.
Any refund due following administrative removal will be calculated in accordance with the refund provisions and applicable Texas law.
