1. Program & Tuition
Adult 6-Hour Driver Education Course — $36
Includes:
- 6 hours of classroom instruction (online)
This course satisfies Texas adult driver education requirements for issuance of the ADE-1317 Certificate of Completion.
Total Instructional Hours: 6 hours
No behind-the-wheel instruction is included in this course.
2. Eligibility
Student must meet Texas eligibility requirements for adult driver education enrollment.
3. Definition of Instructional Hour
For attendance, completion, and refund calculation purposes:
- One (1) instructional hour equals fifty-five (55) minutes of verified instructional time as recorded by the School’s learning management system.
- Online lessons labeled by hour constitute one completed instructional hour once the required timed instruction is satisfied.
- Instructional hours are considered completed when the student satisfies the timed lesson requirement and completes the module.
4. Course Start & Completion Timeframe
- Course Start means the date the Student enrolls in the course.
- The Student has three hundred sixty-five (365) days from the Course Start date to complete the course unless otherwise required by Texas law.
4A. Term of Agreement
This Agreement remains in effect until the earliest of:
- Completion of all required instructional hours and issuance of the ADE-1317 Certificate of Completion;
- Withdrawal by the Student and processing of any applicable refund; or
- Expiration of the 365-day completion period.
The School has no obligation to provide instruction beyond the 365-day period unless required by law.
If the Student does not complete the course within 365 days, re-enrollment and additional tuition may be required.
5. Three-Day Right to Cancel
The Student may cancel within three (3) business days of enrollment and receive a full refund of all tuition paid.
Cancellation must be submitted in writing to info@drivesmartdfw.com.
6. Refund Policy After Three Days
After the three (3) business day cancellation period, refunds will be calculated on a pro-rata basis based on instructional hours completed:
Refund = $36 – (Instructional Hours Completed ÷ 6 × $36)
Refunds will be processed within thirty (30) days of written cancellation.
No Refund After Completion
NO REFUND WILL BE ISSUED ONCE:
- The ADE-1317 Certificate of Completion has been issued;
- The course has been fully completed;
- All required instructional hours have been satisfied and completion documentation has been generated.
Issuance of the ADE-1317 constitutes full performance of the School’s obligations for this course.
7. Transfer Policy
- A Student may transfer to another licensed driver education school.
- Upon written request, the School will provide documentation of instructional hours completed.
- Any refund due will be calculated in accordance with this Agreement and applicable Texas law.
8. Interruption of Training
If training is interrupted for thirty (30) consecutive days or more, the School may require written confirmation of the Student’s intent to continue.
Failure to respond may result in administrative withdrawal consistent with the refund provisions.

10. Limitation of Liability
To the maximum extent permitted by law, the School’s total liability for any claim arising from this course shall not exceed the total tuition paid by the Student.
This limitation does not apply where prohibited by law.
11. Dispute Resolution & Arbitration
A. Mandatory Arbitration
Except for claims eligible for small claims court, any dispute arising out of or relating to this course shall be resolved through binding arbitration administered by the American Arbitration Association (AAA).
Arbitration shall occur in Denton County, Texas. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
B. Class Action Waiver
Disputes must be brought solely in an individual capacity. No class or representative actions are permitted.
C. Waiver of Jury Trial
To the extent any claim proceeds in court, both parties waive the right to trial by jury.
D. Attorney’s Fees
In any dispute arising from this Agreement, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs.
E. Statutory Rights Preserved
Nothing in this section waives or limits any rights the Student may have under Texas Occupations Code Chapter 1001 or rules administered by the Texas Department of Licensing and Regulation (TDLR).
F. Severability
If any portion of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
12. Acknowledgment (Informational)
This section is provided for clarity and reference regarding key terms of the program:
- Students are responsible for reading and understanding the terms of this Agreement.
- Refunds are calculated using the formula listed in Section 6.
- No refund is issued after ADE-1317 issuance, course completion, or generation of completion documentation.
